Texas Vape Laws in 2026: What Got Banned, Who Won, and What Is Nixodine?

If you’re shopping for vapes in Texas — or you’re just trying to figure out why half the products that were on shelves six months ago have disappeared — you need to read this. We’re covering exactly what Texas SB 2024 changed, which brands came out winners, what happened to Delta-8 and hemp vapes, and everything you need to know about the new Nixodine devices showing up at retail.

Here’s what happened in Texas

The Texas vape market got hit with two major laws in quick succession, and only one of them got much attention.

The first was a packaging law that took effect January 1, 2024. It banned cartoon characters, celebrity images, candy artwork, and anything that looked like it was targeting kids. Dozens of popular disposable brands had to redesign their packaging or stop selling in Texas entirely. Big deal — but manageable.

The second law, Senate Bill 2024, was a different animal altogether. Governor Abbott signed it June 20, 2025. It took effect September 1, 2025. And it didn’t just change how products looked — it changed which products could legally exist on Texas shelves at all.

Jan 2024
Packaging law takes effect. Cartoon characters, food imagery, and celebrity likenesses banned on all Texas vape packaging.

Apr–Jun 2025
SB 2024 passes and gets signed. Original bill would have banned all Chinese-hardware vapes. Final text was narrowed to ban only Chinese-made e-liquid. Governor Abbott signs it June 20. Legal challenge filed — Texas Supreme Court allows enforcement to proceed.

Sep 1, 2025
SB 2024 enforcement begins. Chinese-filled disposables, all cannabinoid vapes (Delta-8, THCA, CBD), and disguised-device formats become illegal to sell in Texas overnight.

2026
Market rebuilds around U.S.-made liquid. American-fill brands surge. Nixodine devices land on shelves. Two more bills (HB 3772, SB 1182) advance in the legislature.

The big misunderstanding: it’s about the liquid, not the hardware

This is where most people — including a lot of retailers — got confused. SB 2024 did not ban Chinese-made vape hardware. It banned Chinese-made e-liquid.

The law’s prohibition applies specifically to the consumable liquid inside the device. That means a Geek Bar built in Shenzhen but filled with American-made e-liquid is technically compliant under the current text. A “Made in China” label on the hardware alone doesn’t make a product illegal to sell in Texas. What matters is where the liquid was formulated and filled.

The rule for retailers

For every disposable SKU on your Texas shelves, get written documentation from your distributor confirming the e-liquid’s country of origin. Verbal assurances don’t cut it. If enforcement comes knocking, that paper trail is your protection.

SB 2024 also banned four other categories outright:

  • Products containing cannabinoids — THC, Delta-8, THCA, CBD, and related compounds (except TCUP-authorized products)
  • Products containing kratom, kava, mushrooms, alcohol, or tianeptine
  • Packaging depicting cartoon characters, celebrities, candy, or food imagery aimed at minors
  • Devices designed to look like non-vape objects — pens, highlighters, phones, USB drives, smartwatches, etc.

Serious legal exposure: Selling cannabinoid vapes in Texas after September 1, 2025 is a Class A misdemeanor — up to $4,000 in fines and up to one year in jail per offense. Pull those products off your shelves.

Which brands survived — and which ones got knocked out

Most of the dominant disposable brands in 2024 were manufactured and liquid-filled in China. SB 2024 made those products illegal to sell in Texas overnight. Some brands had the supply chain infrastructure to pivot. Most didn’t.

Fifty Bar

Fully compliant

The original American-fill disposable. E-liquid from Beard Vape Co. in Thousand Oaks, CA. SB 2024 turned their supply chain into a massive competitive advantage. Now has a Nixodine variant too.

Foger

Compliant

Rebuilt the Switch Pro and Bit 35K with U.S. filling and final assembly for Texas. Global hardware, domestic liquid. 10–15 day restocking cycle vs. 60–90 days from overseas.

UNO NiNE Kit

Compliant

USA-made liquid, pod-based system. Smooth and boost modes, 850mAh battery, 12 flavors. One of the most-cited Texas-compliant standouts heading into 2026.

Lost Mary MT35K USA

Select models only

MT35K USA and MT35K Nixodine editions are compliant. The standard Chinese-filled MT35K is not.

Geek Bar CLR

Verify per SKU

Some CLR models are positioned as Texas-compatible. Always request liquid origin docs for the specific SKU before stocking in Texas.

Geek Bar (standard)

Non-compliant in TX

Most legacy Geek Bar models are liquid-filled in China. Cannot be sold legally in Texas without U.S. liquid origin documentation. Fully available online in most other states.

What happened to hemp and Delta-8 vapes?

Short answer: they’re gone from Texas retail. SB 2024 banned Delta-8, THCA, CBD, and all other cannabinoid vape formats from Texas retail sale entirely — the only exception is products prescribed through the Texas Compassionate Use Program (TCUP), limited to licensed dispensaries for registered patients.

The law bans retailers from selling cannabinoid vapes. It doesn’t ban adult consumers from possessing them. But no Texas store — physical or online — can legally sell cannabinoid vapes into the state. This was a complete market wipeout for an entire category.

More regulation is coming — here’s what to watch

HB 3772 would create a state registry requiring all nicotine-containing e-cigarettes to be certified with Texas and comply with FDA regulations. In plain terms: no PMTA authorization, no legal Texas sales.

SB 1182 proposes a statewide ban on all flavored tobacco products, including flavored e-cigarettes and menthol. If it passes, even U.S.-made flavored e-liquids — currently legal — would be off the table.

For retailers: SB 2024 compliance is the floor, not the finish line. The Texas regulatory environment is still in motion — watch both bills closely and treat your current compliant inventory as a temporary state, not a permanent safe harbor.

“Texas didn’t just tighten vape regulations — it flipped the entire scene on its head. Overnight, countless brands disappeared from shelves, leaving retailers scrambling and customers wondering what happened.”
— Fifty Bars brand blog, December 2025

So what exactly is Nixodine?

You’ve been seeing “Nixodine” on more and more disposable packaging over the past year. Here’s what it actually is — not marketing copy, but the real explanation.

Nixodine is a patented, non-nicotine active ingredient developed by Bonguard Naturals and distributed through Nicotine River. It’s designed for adult nicotine vapers (21+) who want an experience similar to what they’re used to — but with zero actual nicotine in the formula. No tobacco derivatives. No nicotine metabolites, including cotinine, showing up in blood or urine tests. And because it drops into standard VG/PG e-liquid, manufacturers use the exact same hardware. No redesign required.

First gen vs. current gen — a meaningful difference

The original Nixodine product was called Nixamide, and it used nicotinamide — a form of Vitamin B3 — as its active ingredient. The problem: nicotinamide has essentially no pharmacological activity at nicotinic acetylcholine receptors (nAChRs). The receptors your brain uses for nicotine. Users reported vapor, flavor — but not much else. The hit wasn’t there.

The current product, Nixodine-S, is genuinely different. Its active ingredient is (S)-6-Methylnicotine (6-MN) — a botanical structural analog of nicotine that actually activates nAChRs. Research published in Nature in the 1960s found 6-MN to be roughly 25% more potent than nicotine in animal models. Nixodine-S vapers report a noticeably more satisfying experience than Nixamide, for exactly this reason.

What vapers actually notice

The most consistent feedback: softer, smoother throat hit compared to 50mg nicotine salts — especially on dessert and tobacco flavors, less so on iced and menthol profiles. Flavor tends to come through very cleanly since 6-MN is nearly tasteless and odorless. Vapor production and device performance are identical — it’s the same hardware.

Why Nixodine matters specifically in Texas

Here’s the key regulatory angle: SB 2024’s list of banned substances covers cannabinoids, kratom, kava, mushrooms, alcohol, and tianeptine. 6-Methylnicotine is not on that list. A Nixodine product that’s U.S.-filled, in compliant packaging, and not disguised as a non-vape object appears to sit cleanly outside SB 2024’s prohibition structure. Brands are marketing this explicitly. Confirm with legal counsel before stocking — but the position looks favorable.

Nixodine is not the same as a 0mg vape

This trips people up. Zero-nicotine (0mg) vapes have no active ingredient whatsoever — just VG, PG, and flavoring. No pharmacological activity.

Nixodine-S vapes contain an active compound (6-MN) that works on the same brain receptors as nicotine. These products are designed for adults who already vape nicotine and are looking for an alternative — not for first-time users. Every Nixodine brand makes this clear in their marketing. 21+, existing nicotine users only.

Heads up: Nixodine is new. Long-term independent human research on 6-MN at vaping concentrations is limited. Bonguard Naturals itself notes it “may be habit forming.” This is not a cessation product. It’s an alternative for existing adult (21+) nicotine vapers, period.

What this means for you as a shopper

If you’re in Texas: nicotine vaping is fully legal. SB 2024 didn’t ban vaping — it banned specific product types and liquid origins. Buy from retailers who stock U.S.-filled devices and you’re good. If budget is top of mind, check out VapeOwls’ disposable vapes under $10 — solid picks that won’t break the bank. Standard Geek Bar models are off Texas store shelves for now, but fully available online for most other U.S. states.

If you want to try Nixodine: the Fifty Bar 20K Nixodine and Lost Mary MT35K Nixodine are the most established options. If you want serious puff count, several Nixodine devices sit in the 50,000-puff category. Nixodine-S is not a zero-nic vape — it has an active ingredient that works, and it’s made for people who already vape nicotine.

Key takeaways
Adult nicotine vaping is legal in Texas. SB 2024 restricts specific product types — not vaping itself.

It’s about the liquid origin, not the hardware. Chinese device + U.S. e-liquid = compliant. U.S. device + Chinese e-liquid = not compliant.

All cannabinoid vapes are banned from Texas retail — Delta-8, THCA, CBD, everything. Only TCUP products are exempt.

HB 3772 and SB 1182 are both advancing. More Texas regulation is likely — treat current compliance as a baseline, not a guarantee.

Nixodine-S is pharmacologically active — not a 0mg vape. For existing adult nicotine consumers (21+) only. May be habit-forming.
